LIMITATION OF LIABILITY & ARBITRATION AGREEMENT
This site is provided by Atheris Rifle Co on an "as is" and "as available" basis. Atheris Rifle Co makes no warranties, either expressed or implied, as to the operation of the site or the content contained therein. You expressly agree that your use of www.atherisrifle.com and all products purchased or obtained (whether directly or indirectly) from Atheris Rifle Co is at your own risk.

Firearms and firearm parts are dangerous if used incorrectly and are sold by us with the specific
understanding that we are not responsible in any manner whatsoever for their safe handling or resale under any laws or regulations. Atheris Rifle Co, its owners, and employees shall not be responsible in any manner for malfunctioning of the firearm (or other product), for physical injury, or for property damage caused by said parts or firearms. It is the user’s responsibility to understand their firearms, firearm parts, and accessories enough to ensure proper and safe operation.
The limitations of liability include but are not limited to:
- Intentional or negligent discharge
- Improper or careless handling
- ANY Modifications
- Defective, improper, reloaded, or non-standard ammunition
- Corrosion
- Neglect or abuse
- Any and all other influences beyond our direct control
- ANY event not specified here including injury and/or loss of life.
This limitation applies regardless of whether other liability is asserted on the basis of contract, negligence or strict liability (including failure to warn). Under no circumstances shall Atheris Rifle Co, its owners, or employees be liable, whether in contract, negligence or strict liability, for incidental or consequential damages, such as loss of property, commercial loss, loss of earnings or profits, loss of life, or any other unspecified damages.

In using this website and/or our products whether obtained directly or indirectly, you agree to the following:
IN NO EVENT WILL YOU OR WE HAVE ANY LIABILITY GREATER THAN $250 TO THE OTHER FOR ANY LOST PROFITS OR REVENUES OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, COVER OR PUNITIVE DAMAGES HOWEVER CAUSED, WHETHER IN CONTRACT, TORT OR UNDER ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In the event that you would like to pursue legal action, You and Atheris Rifle Co agree that any dispute, claim, or controversy between you and Atheris Rifle Co. arising in connection with or relating in any way to these Agreements or to your relationship with Atheris Rifle Co as a user of our services and/or products (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether the claims arise during or after the termination of the Agreements) will be determined by mandatory binding individual (not class) arbitration. You and Atheris Rifle Co further agree that the arbitrator shall have the exclusive power to rule on his or her own jurisdiction, including any objections with respect to the existence, scope or validity of the Arbitration Agreement or to the arbitrability of any claim or counterclaim. Arbitration is more informal than a lawsuit in court. THERE IS NO JUDGE OR JURY IN ARBITRATION, AND COURT REVIEW OF AN ARBITRATION AWARD IS LIMITED. There may be more limited discovery than in court. The arbitrator must follow this agreement. This arbitration provision will survive termination of the Agreements. YOU AGREE THAT OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY REASON IS TWO HUNDRED AND FIFTY DOLLARS ($250). Additionally, the party that initiates arbitration agrees to pay any and all arbitration fees and costs.
Rifle Orders:
-If you do not provide an FFL for your purchase we will choose the closest one to your home address that you provide at checkout.
-We take no responsibility for the transfer policies at FFL's chosen when you do not provide an FFL at checkout, including but not limited to transfer fee and paperwork requirements.

ALL FIREARM, UPPER, LOWER AND AMMUNITION SALES ARE FINAL. NO RETURNS, ONCE SHIPPED, ACCEPTED ON THESE ITEMS.

Refunds on built to order but not yet shipped will incur a 15% restocking fee (including but not limited to: Lowers, Uppers, pistols, rifles, etc). Once shipped they are non refundable.
CERAKOTED ITEMS ARE CONSIDERED CUSTOM AND THEREFORE NON REFUNDABLE AND NOT ABLE TO BE CANCELED, NO EXCEPTIONS
If you place an order and then cancel it for any reason you will receive a refund back to your credit card. You will, however, be charged a 15% restocking/cancellation fee for any order which is cancelled. This fee is non-refundable. You also agree not to initiate a chargeback to recover the restocking fee. If you do initiate a charge-back on an order you cancel you agree to pay all charge-back fees to Atheris Rifle Co and agree to let Atheris Rifle Co charge any payment method you have on file to recover any fees mentioned herewithin this clause. There are no refunds on firearms if the firearm has shipped from our premises. There are also no refunds on receiving an item and then returning it in a used condition. At our discretion we may credit you store credit for a returned item in brand new condition. Determination of whether an item has been used or not is the prerogative of Atheris Rifle Co. Uppers in which you customize and choose options are, according to law, made to order items.
You should expect to receive your refund within 14 business days of your item being delivered back to us, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).
